Unless otherwise informed in a specific privacy statement, for purposes of data protection laws, the respectively mentioned Aiper affiliate is the “data controller” (or similar term under applicable laws) and is generally responsible for and controls the processing of your personal information in the course of your use of our Services.

b. Territorial Scope

This Privacy Notice is designed to apply to our Services on a global basis. Please refer below for additional disclosures that may be applicable to you:

2. What Personal Information We Collect About You and How We Collect It

When you visit our Website, use our App, or otherwise interact with us in the context of our Services, we may be collecting personal information about you. Sometimes we collect personal information automatically when you interact with our Services and sometimes, we collect the personal information directly from you or from another source as described in the following.

Personal Information You Provide

We may collect the following personal information you provide in connection with our Services:

 Account Creation and Profile Information for an Aiper Account (“Account Information”). We will collect personal information that you provide if you decide to register an account on our Website or our App (where available). The Account Information includes the following: Name, account name (email address), password (encrypted), avatar, nickname, country/region you selected during account registration, email verification code, and account ID. You are not legally or contractually obligated to provide the above personal information to us, but you may not be able to open an Account and use our related Services without providing the data.

 Feedback Information: We will collect the information that you provide to us when you (i) use feedback-related services on our Website or our App, such as, the issue type, the machine involved, issue description, contact email, and pictures or videos you upload, or (ii) complete one of our surveys by providing responses to the questions set out therein. You are not legally or contractually obligated to provide the above personal information to us, but we may not be able to obtain your feedback and react to it if you do not provide it.

 Customer Service-Related Information: When you contact us through any method of communications, including through the “Contact Us”, “Chat” or “Support” functions on our Website or App for customer service related matters, we may collect and/or process information used to verify your identity (name, email address, phone number, product purchase channel, product series name, product model and order number), other information on your Aiper product or service, other information included in the content of messages, communications records (including call recordings) automatically stored or collected, contact information (name, phone number, e-mail and postal address, contact numbers, and mailing information used for customer / after sales service) you choose to provide to us, and other information required for handling your requests such as the required service category and the product serial number. Additionally, we may also collect other information provided by you to obtain customer services, such as troubleshooting and online customer support. You are generally not legally or contractually obligated to provide the above personal information to us, but we may not be able to communicate with you and/or provide you the customer service you if you do not provide it.

 Communication Information. When you contact us through any method of communications, including through the “Contact Us”, “Chat” or “Support” functions, or any other channels we provided on our Website or App, we may collect your name, email address, mailing address, phone number, company/company URL, account ID, type of inquiry, a possible report about illegal content in our Services, content of your messages, communications records automatically stored or collected, and/or any other personal information you choose to provide to us.  You are not legally or contractually obligated to provide the above personal information to us, but we may not be able to communicate with you and resolve your inquiry if you do not provide it.

 Contract Management Information: For contract management purposes, including for our documentation and to provide you with records related to contract management, we collect information, such as, the version number of the Privacy Notice which you are aware of, your consent or rejection of specific Services or functions, version number of the service contract you agree to or refuse; and the timing of your aforementioned actions. You are not legally or contractually obligated to provide the above personal information to us, but you may not be able to use our related Services without providing the data.

As it relates to our Website, we may further collect the following personal information you provide in connection with our Services (or as otherwise described in the following):

 Order and Shipping Information. If you use our online store and order any items or if you order items from us on a third-party marketplace (such as, Amazon or BestBuy) in cases where we are performing the shipping, we may collect the following information in relation thereto, whereas in the case of a third-party marketplace the information may be provided to us by the relevant marketplace: Customer total orders, customer paid orders, customer total payment, customer first order date, customer last order date, order notes, third-party marketplace (where applicable), billing information (such as first name, last name, full name, company, address, city, state code, zip, state name, postcode, country code, country name, email, and phone), and shipping address, and payment information (such as your method of payment and related details). You are not legally or contractually obligated to provide the above personal information to us or to a third-party marketplace, but you may not be able to order a product from us or a third-party marketplace without providing the data.

 Discount and Benefit Information. If you are eligible to enjoy any discount or benefits provided by us in connection with our Services, we will also collect the voucher, coupon or any other similar information about such benefits, including the participation status and rewards information relating to our promotional events or loyalty program, to provide you with relevant discount or benefits. You are not legally or contractually obligated to provide the above personal information to us, but you may not be able to enjoy the discount or benefit from us without providing the data.

 Newsletter and Marketing Emails: If you sign up to receive news or alerts from us, we may collect your email address. We may further collect information about us sending you these e-mails (such as time, date, and content) and about your reactions to our marketing activities. You are not legally or contractually obligated to provide your e-mail address and sign up.

 Distributors Contact Information: When you work for a distributor, we may collect your name, position, email, phone number, company information (company name, country, website), sales channels, sales representative name to facilitate the relevant cooperation with you as the distributor contact person. You are not legally or contractually obligated to provide the above personal information to us, but we may not be able to communicate with you if you do not provide it.

 Review Information: If you provide a product review, we collect information (such as name, email, review title, text and photos you submitted as review content, rating records, review like and dislike history). There is no legal or contractual obligation to provide the above personal information to us, but you may not be able to provide a product review if you do not provide it.

Personal Information Automatically Collected

As is true of most digital platforms, we and our third-party providers and partners collect certain personal information automatically when you visit, interact with, or use our Service:

 If you use our Website or App: If you use our website or App, we may collect Services Usage Information which includes the following:

 In relation to the use of our Website: IP address, operational behavior data collected through your interaction with our Services (such as clicks, search, time stamp, browsing history, video playback records and buffering situation, date/time of your visit, the time you spent on our services, and purchase history), Device Information (such as brand, operating system, and version of the device, browser details such as type, ID, and configuration, unique identifiers).

 In relation to the use of our App and Machine: Cleaning history (start and end times, and durations); sensor information, such as water quality information, temperature information and/or information on the category of rubbish (as determined locally by  the cleaning machine) collected from your paired Machine (if your paired Machine supports relevant functions); operational behavior data collected through your interaction with our services (such as clicks, dwell time, time stamp, and browsing history), diagnostic and performance information (such as system events, crash reports, and performance logs), basic information of the Machine paired to the App (such as battery and charging information, network connection status, Machine status, cleaning mode, direction, usage duration, and other operation logs), Machine Information (such as serial number, model, firmware version, and firmware file of your Machine), Device Information (such as brand, operating system, and version of the device, unique identifiers), and Network Information (such as name and password of the Wi-Fi you provided for Machine paring, Bluetooth name, and Machine hotspot name).

 Cookie information: To the extent we collect the aforementioned Services Usage Information and other personal information in the context of cookies on our Website, please see the specific information set out under our Cookie Notice.

You are not legally or contractually obligated to provide the above personal information to us, but you may not be able to use our Services without providing some of the data. As it relates to cookies, please see the specific information set out under our Cookie Notice.

 

3. How, Based on Which Purpose, and Legal Basis We Use Your Personal Information

We may use the personal information we collect for the following purposes and, if you are located in the EEA or UK, based on the respective legal basis mentioned in the following:

 User Account Management: We process your Account Information to provide you with functions related to the user account management, such as account registration, account cancellation, account login, and modification of account information. The legal basis for the processing is the performance of our contract with you.

 Customer Service and Support: When you contact or consult any issues via online customer service, or use hotline services for inquiries or complaints, we may process some of your Account Information and Customer Service-Related Information, and Feedback Information to fulfil your customer service request and respond to your inquiry. The legal basis for the processing is the performance of our contract with you. We will ask for your consent before recording a phone call with you as required by applicable law.

 Communications: When you contact or consult us on any non-customer service-related matters via any communication channel, we may process (some of) your Account Information and Communication Information to fulfil and respond to your inquiry and communicate with you. The legal basis for the processing is our legitimate interest to fulfil and respond to your inquiry and communicate with you.

 Investigations: We may process some of your Account Information and/or Services Usage Information or other personal information for the purpose and our legitimate interest of detecting, and protecting against, fraud, other criminal activity, or other violations of our policies and rules.

 Compliance with a Legal Obligation: We may process any personal information if this may become necessary for our compliance with a legal obligation. The legal basis for our processing is the compliance with a legal obligation if we process your data to comply with a legal obligation based on EEA or UK law. Otherwise, the legal basis is our legitimate interest to comply with a legal obligation or to disclose the data for one of the other aforementioned purposes.

 Establishment, Exercise, or Defense of Legal claims: We may process any personal information if this may become necessary to establish, exercise, or defend against a legal claim. The legal basis for our processing is our legitimate interest to establish, exercise, or defend against a legal claim.

 Newsletter and Marketing Emails: If you sign up to receive news, alerts, or invitations to promotional events from us, we may process your email address to send you these communications as well as related information about these communications (such as time, date, and content) and about your reactions to our marketing activities and your attendance of promotional events. We will ask for your consent before conducting this processing activity as required by applicable law. Otherwise, the legal basis is our legitimate interest to send you such marketing communications.

 Marketing and User Preference Analysis: We process some of your Account Information such as email and postal address, Order Information and Services Usage Information, to provide you with marketing campaigns and analyze user preferences. We will ask for your consent before conducting this processing activity as required by applicable law. Otherwise, the legal basis is our legitimate interest to provide you with marketing campaigns and analyze user preferences.

 Ensure Security and Stable Operation as well as Plan Improvements: We process

 In case of your use of our Website: your region, network provider, device type, operating system, browser type, screen resolution, view history, access source, access date, mouse clicks, mouse hovers, dwell time, video playback; or

 in case of your use of our App and Machine: Mobile Device Information, Network Information, and Services Usage Information

to identify the abnormal status of your account or, in case of the App, your machine, ensure the stability and security of our Services, and plan improvements or upgradation of our Services. The legal basis for the processing are our legitimate interests in carrying out the processing to ensure the security and ongoing stability of the Services, and improve or upgrade of our Services.

 Contract Management: We process Contract Management Information for contract management purposes, including for our documentation and to provide you with records related to contract management, such as records of your agreement/refusal actions, version numbers of contracts/privacy notice related to you, time, etc. The legal basis for the processing is the performance of our contract with you to the extent that the processing is necessary for the performance of the contract. Otherwise, the legal basis for our processing is the compliance with a legal obligation if we process your data to comply with a legal obligation based on EEA or UK law and, if not, the legal basis is our legitimate interest to perform our contract management and obtain relevant documentations in relation thereto.

 Online Shopping: We process your Account Information, Order and Shipping Information, Discount and Benefit Information, and Review Information to provide you with functions related to online shopping, such as order placement, product delivery, our loyalty program, discounts and benefits, as well as product review. The legal basis for the processing is the performance of our contract with you.

 Distributor Cooperation: We use the Distributors Contact Information to facilitate relevant cooperation by contacting the distributor contact person. The legal basis for the processing is the consent of the distributor contact person.

 User survey: We process your email address to send you a survey questionnaire. In addition, we will also complete and analyze the survey activity based on your name and Feedback Information. The legal basis for the processing is your consent.

 Device Control: We process your App Account Information and Machine Information to provide you with services related to Machine control, such as the pairing, unpairing, and upgrades of your Machine. The legal basis for the processing is the performance of our contract with you.

4. With Whom and How We May Share Personal Information

We may also share, transmit, disclose, grant access to, make available, and provide personal information with and to external recipients, as described below.

 Service Providers: We share personal information with external contractors and service providers, who provide us with IT services (including IT-related cloud services), business support, legal and accounting support, customer services, payment processing, marketing, and online advertising services. Any such external contractors and service providers will be subject to confidentiality provisions, and be bound to only process the data on our behalf and under our instructions, unless such external contractors or service providers act as their own controllers (e.g., in the case we seek advice from lawyers).

 Aiper Group: We may share personal information with other affiliates of the Aiper Group for legitimate business purposes as well as regarding the provision and operation of our Services.

 Corporate Transaction: We may disclose any personal information to a purchaser or another external entity in connection with a transaction, such as a merger, sale of assets or shares, transfer of services, reorganization, financing, change of control or acquisition of all or a part of our business.  If you are located in EEA or UK, the legal basis for such processing will generally be our legitimate interest of preparing, taking part, and/or completing such transaction.

 Legal Obligations and Rights: We may disclose personal information to third parties, such as external auditing firms, legal advisors, other professional consultants, and law enforcement agencies, regulators, other authorities, and courts, for legal reasons if we reasonably believe that such action is necessary:

 in connection with the establishment, exercise, or defense of legal claims;

 to comply with laws or to respond to lawful requests and legal process;

 to protect our rights and property and the rights, personal safety and property of others, including to enforce our agreements and policies;

 to detect, suppress, or prevent fraud; or

 as otherwise required by applicable law.

If you are located in EEA or UK, the legal basis for our processing is the compliance with a legal obligation if we process your personal information to comply with a legal obligation based on EEA or UK law. Otherwise, the legal basis is our legitimate interest to comply with a legal obligation or to disclose the data for one of the other aforementioned purposes.

Where the transfer of personal information to any of the aforementioned external parties and/or affiliates constitutes an international transfer, please see the related descriptions under Section 6.

Please note that our Privacy Notice is applicable solely to the data collection and processing activities conducted by Aiper in relation to its Website and App and does not extend to the data collection and processing activities of third-party websites / applications and third parties, who are themselves responsible for and control the processing of the personal information. Please be advised that when interacting with such third-party websites/applications, you may disclose personal information to them, and these third parties may have distinct privacy notices and practices. We strongly recommend that you review the privacy notices of these third parties to ascertain how they handle your personal information.

 

5. Where And How Long We Retain Your Personal Information

a. Location of Our Servers

If you use the Website or our App from the United States, your data will be processed on servers located in the United States; if you use the Website or our App from the “Europe” region, your data will be processed on servers located in Germany. Additionally, to support our global operations, we may also back up some of your data at our data center located in Singapore.

b. Retention Periods

In general, we will only retain your personal information (i) for as long as necessary to fulfil the purposes we collected or otherwise processed it for, including as it relates to Account Information and other information associated with your account until you decide to delete your account, (ii) until you withdraw your consent on which the processing is based, where there is no other legal ground for the processing, or (iii) if you are located in the EEA or UK, until you successfully exercise your right to object as stipulated under Section 13, in each case to the extent that the exceptions set out in next paragraph do not apply.

We may particularly refrain from erasing your personal information if its continued processing is necessary for compliance with a legal obligation (including statutory retention obligations, such as under tax law) or for the establishment, exercise or defence of legal claims.

6. How We Transfer Your Data Internationally

As it relates to the processing of your personal information relating to our Website and App, we maintain servers located in the United States, Germany, Australia, and Singapore.

Your personal information may be processed on servers located outside of the country or region where you live. For example, personal information of UK users may be stored in Germany. Because of the international nature of our business, your personal information may also be accessed by our affiliates or be transferred to external recipients, such as, third party customer service providers or third-party cookie providers, in connection with the purposes set out in this Privacy Notice. This may also include the transfer of your personal information to other jurisdictions that may have different laws and data protection compliance requirements to those that apply in the jurisdiction in which you are located. Data protection laws vary among countries, with some providing more protection than others.

In the event of an international transfer of personal information, when required by applicable law, we will provide an adequate level of protection for your personal information by appropriate means, including where appropriate, relying on a formal decision that a certain country ensures an adequate level of protection for personal information, or implementing appropriate data protection clauses.

7. What Are Your Data Subject Rights and Choices

You may have the following rights and choices regarding your personal information:

a. Data Access

You may access your account-related personal information on the Website under My Account > Account details or in the App under Settings > Personal Data. If you have any other requests relating to the access of your personal information, please contact us.

b. Data Correction

You may correct some of your account-related personal information on the Website under My Account > Account details or in the App under Settings > Personal Data. If you have any other requests relating to the correction of your personal information, please contact us.

c. Data Portability

You may contact us to request the personal information you have provided to us in a structured, commonly used and machine-readable format and have it transferred to another controller, to the extent applicable.

d. Data Deletion 

You may request to delete all your personal information by contacting us under the details set out in Section 11. You may further request for the deletion of your App account through this path in the App: “Me - Personal Information - Delete Aiper Account”. We will then delete your personal information in accordance with Section 5.b of this Privacy Notice.

e. Withdrawal of Consent

Where we process your personal information on the basis of your consent, you may withdraw your consent with future effect by contacting us under the details set out in Section 11.

f. Objection to the Processing

Subject to applicable law, you may object to the processing of your personal information based on our legitimate interests where there are grounds relating to your particular situation by contacting us under the details set out in Section 11. If we cannot take action on your request, we will inform you of the reasons.

g. Restriction to the Processing  

If you would like to restrict our processing of your personal information, please contact us under the details set out in Section 11. You have the right to restrict the processing of your data where one of the following applies:

 the processing is unlawful, and you oppose the erasure of relevant personal information;

 for the purpose of establishment, exercise or defense of legal claims, you request us to retain your personal information that we were supposed to delete;

 your objection regarding the accuracy of your personal information is pending our verification;

 your request to object to the processing of your personal information is pending our verification.

h. Other Rights

Depending on your jurisdiction, you may be entitled to additional rights in relation to your personal information. For example, you may also have the right to lodge complaints with an applicable data protection authority if you consider that the processing of your personal information infringes any applicable data protection laws

If you are using our Services from the EEA or the UK, your specific data subject rights are set out under Section 13. These specific data subject rights set out there prevail over the data subject rights set out under this Section 7 in case of any deviations.

If you would like to contact us to exercise one or more of these rights, to ask a question about these rights or any other provision of this Privacy Notice or about our processing of your personal information, or to file a complaint about how we process your personal information, you may use the contact details provided in Section 11 below. When submitting a right request, please specify the scope and basis of your request and provide us with the necessary information to verify your identity. We may contact you to confirm your identity in order to handle your request. We will respond to your request or complaint in due course under applicable data protection laws.

8. Children

Our Services are not directed to, and we do not intend to, or knowingly, collect or solicit personal information from children. If you are under the legal age requirement for adults in your jurisdiction, you should not use our Services or otherwise provide us with any personal information either directly or by other means. If you are a parent or guardian and become aware that a minor is using our Services, please contact us to stop the relevant provision of Services by using the contact details provided in Section 11 below.

The Services may contain integrations or links to third party websites or services, including those of our business partners.  By interacting with these third parties, you are providing information directly to the third party and not Aiper.  Please note that Aiper is not responsible for the privacy practices of these third parties or any entity that it does not own or control.  We encourage you to review the privacy notices and online terms of those third parties to learn more about how they handle your personal information.

 

10. Changes to Privacy Notice 

We reserve the right to change this Privacy Notice from time to time in our sole discretion.  We will notify you about material changes in the way we treat personal information by adequately informing you via your account, by placing a prominent notice on our website, or through other appropriate communication channels.  It is your responsibility to review this Privacy Notice periodically. All changes shall be effective from the date of publication unless otherwise provided.

As further described in the How We Share Your Personal Information section of the Privacy Notice, we may “sell” your personal information to third parties (as that term is defined by the CCPA), subject to your right to opt out of those sales (see Exercise Your Right to Opt-Out below).

The Right to Opt-Out of Personal Information Sales

You have the right to direct us not to sell personal information we have collected about you to third parties now or in the future.

If you are under the age of 16, you have the right to opt in, or to have a parent or guardian opt in on your behalf, to such sales.

The Right to Non-Discrimination

You have the right not to receive discriminatory treatment for exercising these rights.
However, please note that if the exercise of these rights limits our ability to process personal information (such as in the case of a deletion request), we may no longer be able to provide you our products and services or engage with you in the same manner.

California residents that have an established business relationship with us have rights to know how their information is disclosed to third parties for their direct marketing purposes under California’s “Shine the Light” law (Civ. Code §1798.83).

Exercise Your Right to Access, Right to Know, and Right to Deletion

To exercise your Right to Access, Right to Know or your Right to Deletion, please submit a request by:

Before processing your request, we will need to verify your identity and confirm you are a resident of the State of California. In order to verify your identity, we will generally either require the successful authentication of your account, or the matching of sufficient information you provide us to the information we maintain about you in our systems. This process may require us to request additional personal information from you, including, but not limited to, your email address, phone number, and/or date of last transaction on our Services.

In certain circumstances, we may decline a request to exercise the rights described above, particularly where we are unable to verify your identity or locate your information in our systems. If we are unable to comply with all or a portion of your request, we will explain the reasons for declining to comply with the request.

Exercise Your Right to Opt-Out and California’s Shine the Light

Unless you have exercised your Right to Opt-Out, we may disclose or “sell” your personal information to third parties for monetary or other valuable consideration. The third parties to whom we sell personal information may use such information for their own purposes in accordance with their own privacy policies.

You do not need to create an account with us to exercise your Right to Opt-Out. However, we may ask you to provide additional personal information so that we can properly identify you to track compliance with your opt-out request. We will only use personal information provided in an opt-out request to review and comply with the request. If you choose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our data systems.

In addition, Shine the Light permits you the right to opt out of the disclosure of personal information to third parties for their direct marketing purposes during the immediately preceding calendar year.

Additionally, as is common practice among companies that operate online, we permit third party advertising networks, social media companies and other third party businesses to collect and disclose your personal information (including preferences, geolocation, commercial information and internet, network and device information) directly from your browser or device through cookies or tracking technologies when you visit or interact with our websites, use our apps or otherwise engage with us. These third parties use this information for the purposes of serving ads that are more relevant, for ad campaign measurement and analytics, and for fraud detection and reporting and may sell that information to other businesses for advertising and other purposes. Authorized Agents

In certain circumstances, you may permit an authorized agent to submit requests to exercise your California Privacy Rights on your behalf.  The authorized agent must provide a letter signed by you confirming the agent has permission to submit a request on your behalf or must provide sufficient evidence to show that the authorized agent has been lawfully vested with power of attorney.

For security purposes, we may need to verify your identity and confirm directly with you that you have provided the authorized agent permission to submit the request, and it may take additional time to fulfil agent-submitted requests. We may deny a request in the event we are not able to verify the authorized agent’s authority to act on your behalf.  Please note that for privacy and security reasons, we will direct future communications to the data subject on whose behalf the request was made.

a. InternationalTransfers of Your Personal Data

The personal data we process from you may be transferred to and stored in countries outside the EEA and UK where we and our external recipients, including our service providers, have operations, including in the United States of America or Singapore.

In accordance with applicable privacy law, you may have the following rights in respect of your personal data that we hold:

 Right of access. You have the right to obtain certain information about our processing of your personal data which includes:

 confirmation of whether, and where, we are processing your personal data;

 information about the categories of personal data that we are processing, the purposes for which we process your personal data, and information as to the envisaged storage period or the criteria used to determine it;

 where the personal data are not collected from you, information as to their source;
